SB 1636 Retainage Reform - SIGNED

IMSCA and FCAI are excited to report IMSCA’s legislative initiative, SB 1636 was signed in to law on August 20, 2019! P.A. 101-0432 is effective immediately. As a reminder, this new law allows retainage to be withheld at a rate of 10% for the first half of a construction project, but is to be reduced to 5% once the project is 50% complete. This new law applies to private construction projects.

Thank you to all the IMSCA's members who worked tirelessly to ensure retainage reform in Illinois became a reality. This legislative success would not have been accomplished without help from all of you. The outreach that you provided to your legislators and to Governor Pritzker is what pushed this bill over the finish line. Thank you to our bill sponsors, former Senator John Mulroe and Representative Luis Arroyo for their leadership on this important issue.

DOL Releases Proposed Rule Establishing Industry-Recognized Apprenticeship Programs (IRAPs)

Comment Now to Keep the Construction Industry EXEMPT!

The parent association of FCAI, FCA International, has been aggressively engaged on protecting our industry’s apprenticeship programs since June of 2017 when President Trump issued the Presidential Executive Order expanding apprenticeships in America. 

During the last two years, FCA International’s Government Relations Advisory Committee has worked tirelessly to educate the Administration and members of Congress on the importance of our industry’s registered apprenticeship programs. Additionally, FCA has teamed up with the Construction Employers of America and other trade associations across the construction industry to ensure our registered apprenticeship programs are protected.

Recreational Marijuana and its Impact on the Construction Industry

Illinois will become the 11th state to permit the use of recreational cannabis. Once the Governor signs the legislation, as promised, beginning January 1, 2020, the Cannabis Regulation and Tax Law (the “Law”), will allow adults (21+) in Illinois to possess and consume cannabis.

While there is a lot “rolled” into the 600 plus page law (pun intended), there are significant employment pitfalls for employers with regard to enforcing drug free workplaces. 

Interestingly, the law is the first of its kind that was legislatively created versus a voter referendum. As a result, there is potential for more legal navigation for Illinois employers. Specifically, the new law aims to protect applicants and employees from adverse job action based on the lawful use of marijuana.

However, the Law permits employers to continue to control its workforce and workplace. The Law expressly permits an employer to:

  1. Adopt reasonable zero tolerance or drug free workplace policies, or employment policies concerning drug testing, smoking, consumption, storage, or use of cannabis in the workplace or while on call provided that the policy is applied in a nondiscriminatory manner;
  2. Prohibit an employee from being under the influence of or use cannabis in the employer’s workplace or while performing the employee’s job duties or while on call; and 
  3. Discipline an employee or terminate employment of an employee for violating an employer’s employment policies or workplace drug policy.
